Course terms and conditions
The following terms and conditions apply to all of our professional training courses.
1. Payment and cancellation
a. Online payment via credit or debit card is preferred. Payment by invoice incurs an additional charge of £30. Please note that the University of York cannot accept American Express cards.
b. Full programme payment is payable in advance of the programme start date.
c. We cannot reserve or hold places for our programmes before booking or payment has been completed.
d. You may cancel your place on a programme by emailing cpd@york.ac.uk.
The following cancellation terms apply:
The following terms apply to individuals as well as to bookings of one to five people from the same organisation:
- Cancellations made 30 days or more before the programme start date:
Your programme registration fees will be refunded, minus a 10 per cent administrative charge. - Cancellations made less than 30 days before the programme start date:
No refund will be given.
If one person from the group booking cancels, substitutes can be made, or the standard conditions apply. The following terms apply if the whole group cancels:
- Cancellations made 60 days or more before the programme start date:
Your programme registration fees will be refunded, minus a 10 per cent administrative charge. - Cancellations made less than 60 days before the programme start date:
No refund will be given.
University cancellation
In the event of the University of York cancelling the programme a full refund will be given, but the University of York will not accept responsibility for any additional costs that you may incur (eg travel arrangements or accommodation).
Discounts and promotional codes
e. If a discount or promotional code is used by ineligible individuals or organisations, your place on the course will be cancelled. Your payment will be refunded and the individual or organisation will be asked to register again with payment at full price.
f. Multiple discounts or promotions cannot be combined.
g. Funding cannot be combined with a promotional discount.
2. Attendance
a. Substitutions may be made up to five days prior to the start date of your programme, provided you email cpd@york.ac.uk and complete any registration documentation for the new delegate. No substitutions are permissible after the start of the programme.
b. Whilst on the programme, if you're unable to attend one of the sessions, your tutor will attempt to support the gap in learning via a one-to-one conversation. They will also provide any relevant presentations and learning aids. It is your responsibility to revise the missed material and compulsory learning hours.
c. If you miss more than one session, you may continue with the programme but will not complete the full programme or receive the full University of York certificate.
d. If a delegate chooses to leave the company which has sponsored their place before the end of the programme, full payment will still be payable and no refunds will be provided. A delegate may take over the responsibility for payment from their previous employer on agreement with said employer.
3. Chartered Management Institute (CMI) accreditation
a. You must commit to the CMI Code of Conduct. You must also agree to the CMI Terms and Conditions and Privacy Policy.
b. You must attend all modules and tutorials.
c. You must complete an additional independent study.
d. You must submit an assignment which is marked as a pass by CMI, within the required timetable.
1. You must inform the University if you require any reasonable adjustments or special considerations. You'll have an opportunity to declare this via a form or survey sent to you after registering. Alternatively, you can email cpd@york.ac.uk at any time.
2. You must read the plagiarism guidance and the CMI induction materials in advance of writing your assignment.
3. You must submit your assignment and learner authenticity statement via email to cmi-cpd@york.ac.uk within six weeks of the final tutorial. The University will then submit your assignment to the CMI for marking.
4. If your assignment does not pass, you'll be provided with feedback. You'll then have four additional weeks to improve your assignment and resubmit again via email, highlighting all changes in blue.
5. One potential resubmission only is allowed without further payment. If your resubmitted assignment does not pass, no further resubmissions can be made without a discussion with the University and a further payment being made.
4. Live online content
a. Live online courses will be managed according to the individual trainer’s preferences. This will be done in the most appropriate way to communicate the subject content and achieve the learning outcomes.
b. You'll be sent a code of conduct before the start of the session, which will also be available in the Virtual Learning Environment
c. You'll informed how the session will run at the start, and also how to ask questions during the session.
d. Trainers and University administrators reserve the right to mute delegates on Zoom whilst the tutor is speaking or at any time.
1. In extreme cases, trainers and University administrators reserve the right to remove delegates from a course if they do not follow the code of conduct.
f. Opinions expressed by delegates in a live session do not constitute the opinion of the University.
g. All live courses will have the potential for you to pose questions, but there is no guarantee that all individual questions will be answered. If the group size and time does not allow for individual answers, the trainer or a University administrator will group questions into themes and will endeavour to address these themes within the session.
h. All live courses will be recorded via Zoom.
i. For the avoidance of doubt, nothing in these terms and conditions shall be construed as granting to the customer any right, title, or interest in any of the intellectual property rights of the University of York.
5. Liability
a. The Learning Management System (LMS) and the Virtual Learning Environment (VLE) are provided to you “as is” and we exclude all representations, warranties, conditions and terms expressed or implied by statute, common law or otherwise to the fullest extent permitted by law. We do not guarantee that:
1. use of the LMS, VLE or Zoom will be compatible with all hardware and software.
2. use of the LMS, VLE or Zoom will be uninterrupted or error or virus free.
3. use of the LMS, VLE or Zoom will deliver any specific outcome for its users, or defects on the LMS, VLE or Zoom will be corrected (save for those defects which the University of York is obliged to correct by law).
4. You must take appropriate steps to ensure that you regularly check for and protect against viruses when using the LMS, VLE or Zoom on any device.
b. We may terminate your account or your access to/use of the LMS or VLE with immediate effect:
1. if we reasonably believe you are in breach of these terms and conditions and/or the code of conduct.
2. in order to prevent any abusive, fraudulent or unlawful activity.
3. where necessary to prevent or stop any harm or damage to the University, any learner or the general public.
c. To the fullest extent permitted by law, the aggregate liability of the University of York, to you, the customer, to under or in relation to these terms and conditions shall be limited to the total price payable by you under these terms and conditions.
d. Nothing in these terms and conditions shall exclude or limit liability for negligence resulting in personal injury or death, fraud, or for any other type of liability that, by law, cannot be limited or excluded.
These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the jurisdiction of the courts of England and Wales.
Through registering for a course, you are deemed to have accepted the above terms and conditions.
