Privacy Notice – job applicants using SAM

This privacy notice applies to information held by the University of York that is collected during, and after, the following assessment: SAM – a Situational Judgment Test for Allied Health Professionals and Mental Health Nurses.

Where do we get your data from?

The University of York (UoY) collect information about you in a variety of ways. These include:

  • Information collected during this assessment (first deidentified by Tees, Esk and Wear Valleys NHS Foundation Trust; TEWV);
  • Anonymised data following interview.

What data do we have?

We hold Personal data including:

  • the role you are applying for;
  • your professional discipline;
  • your length of employment history within TEWV;
  • equal opportunities monitoring information, including information about your date of birth, gender, ethnic origin, language and disability status;
  • your overall outcome of the recruitment process (e.g. whether you are offered the job).

Special category data including information about disability and ethnicity.

What is our legal basis for processing your data?

Processing data from job applicants supports TEWV NHS Foundation Trust to manage the recruitment process. In order to ensure the assessment (SAM) is fair to all applicants, the UoY will regularly review and analyse the data collected, in a deidentified format.

To assess the validity of the assessment, the UoY will obtain additional data from TEWV, including the overall outcome of the recruitment process. Outcomes will be linked to the data obtained during this assessment, but will be deidentified before this data is sent to the UoY.

How do we use your data?

The University may process your personal data (including special category data) for the following purposes:

  1. to assess the validity of the assessment;
  2. to improve the assessment (SAM);
  3. to assess subgroup differences on the assessment based on equality characteristics. 

Who do we share your data with?

Information collected during this assessment will be received by TEWV and used for recruitment purposes. TEWV will subsequently link data related to the overall outcome of the recruitment process to the data collected by SAM and will deidentify this prior to sharing with the UoY for data analysis purposes.

How do we keep your data secure?

The University takes information security extremely seriously and has implemented appropriate technical and organisational measures to protect personal data and special category data. Access to information is restricted on a need-to-know basis and security arrangements are regularly reviewed to ensure their continued suitability. Will you transfer my data internationally?

No. Your data will not be transferred outside of the UK.

How long will we keep your data?

The University will retain your data in line with legal requirements or where there is a business need. Retention timeframes will be determined in line with the University’s Records Retention Schedule.  

What rights do I have in relation to my data?

Data obtained by the UoY will be held in a deidentified format. As such, we will be unable to identify, and provide you access to your data.
