3. Options for employing staff overseas

1. University employees assigned or seconded overseas - This guidance deals with the implications for a Department that has a business need to post an employee to a non-UK country on an assignment or through a secondment to a partner organisation. Normally these staff are paid through the University's payroll.

2. Contract for services via a Third Party - A further option is to enter into a contract for services via a third party, for example a partner University or research institute. In this instance, the individual concerned would not be an employee of UoY but might be registered as self-employed in a non-UK country and has/ arranges for a contract to be set up with the partner organisation. This would require a specific contract for services to be drawn up and would be more suited to short-term assignments. Due to the complexities associated with being able to confirm self-employment status in a non-UK country, UoY is not able to enter into a direct contract for service with an individual.
