Contemporary Philosophy of Law

The purpose of this course is to provide an introduction to some of the major concerns that have dominated recent Anglo-American philosophy of law. This will involve a detailed exploration of the relationship between law and morality. Celebrated debates between Hart, Fuller, and  Dworkin on the nature of law and whether the law is an irredeemably moral enterprise will provide the focus for the first part of the course. The second part of the course will focus on substantive issues in the criminal law such as responsibility and guilt; insanity and diminished responsibility; and the justifications of punishment.
